Lasting Powers of Attorney ensure that you and your finances are looked after by someone that you trust, no matter what life may bring. There are 2 types of Lasting Power of Attorney,
PROPERTY and FINANCIAL AFFAIRS (LPA PA)
LPA PA allows people you trust to look after your bank accounts, pensions and investments as well as other financial assets and property. It also gives them the ability to pay any bills such as utility or council tax on your behalf. We can set this up so that it can be used in the future if you feel now is not quite the correct time or set it up for immediate use if you wish, the choice is yours.
HEALTH and WELFARE (LPA HW)
LPA HW covers decisions regarding your healthcare and personal welfare, including who will look after you in ill health and where you will live. It also gives your loved ones the ability to make decisions regarding any medical treatment you receive if you were unable to make these decisions for yourself. It is not possible for a LPA to be used until it is registered with the Office of the Public Guardian and this process can take up to 8 weeks so this needs to be taken in to account as to when it needs registering. Quite often the trigger for creating a LPA is the onset or diagnosis of a progressive medical condition such as Alzheimer’s or Dementia, we have an understanding and sympathetic approach in these circumstances and will make the process as seamless and smooth as possible.
PROTECTING YOUR PROPERTY
Your home is normally your largest and most expensive asset which you will have worked hard for throughout your life. Your will can be set up to leave your spouse or partner the use of the family property for the rest of their lifetime and on their death your half of the property will pass to your children, either from a past or present relationship. To ensure this happens your joint tenancy needs to be severed, we can take care of this for you and ensure that your half of the property will not be included in any calculations for means-testing should your partner need to go into a home.
